Right to Work Checks & Document Verification

Introduction

The end of the transition period for the UK leaving the EU has had a significant impact on UK employers – who must now ensure they understand the new restrictions upon employing EU citizens and implement the new rules. You are required to carry out Right to Work checks for all your non-UK employees and need to understand the latest Home Office requirements to ensure compliance. That’s quite a challenge, given the sheer volume and complexity of authenticating often unfamiliar documents - carrying out these checks correctly will protect your organisation from fines, penalties as well as reputational damage.

The programme content can be adapted to meet your specific organisational challenges and training needs. The course runs for approximately 6.5 hours and can be adapted for a briefing or half-day session.

What is identity - and why it is important to check, the consequences of getting it wrong;

Examining rights to work - who can work in the UK; an overview of visa categories; a summary of different work routes for non-UK nationals; EEA workers and Brexit implications; tricky areas e.g. student workers and change of visa status. 

Checking identity documents - Do you know what to look for; what documents do you need to see and retain; acceptable documents; documents which do not prove the right to work and why; a checking strategy; common scams to be aware of; what to do when you spot an irregularity; passports; other Photo ID; birth certificates; stamps; visas.

Essential legal issues to consider from an immigration perspective - avoiding discrimination; data storage to ensure GDPR compliance; understanding the statutory excuse and ensuring you have it.
